{"id":23,"date":"2014-08-31T11:13:54","date_gmt":"2014-08-31T11:13:54","guid":{"rendered":"http:\/\/saveoursandwellcanadageese.org.uk\/?page_id=23"},"modified":"2016-09-24T14:23:40","modified_gmt":"2016-09-24T14:23:40","slug":"freedom-of-information-request","status":"publish","type":"page","link":"https:\/\/saveoursandwellcanadageese.org.uk\/?page_id=23","title":{"rendered":"Freedom of information request"},"content":{"rendered":"<p>The <a href=\"https:\/\/www.gov.uk\/make-a-freedom-of-information-request\/the-freedom-of-information-act\" target=\"_blank\"><strong><span style=\"color: #0066cc;\">Freedom of Information Act<\/span><\/strong><\/a> gives you the right to ask any public sector organisation for all the recorded information they have on any subject.<\/p>\n<p align=\"left\">The <a href=\"http:\/\/www.ico.gov.uk\/for_organisations\/environmental_information\/~\/media\/documents\/library\/Environmental_info_reg\/Detailed_specialist_guides\/guide_to_environmental_information_regulations.ashx\">Environmental Information Regulations 2004 <\/a>provide public access to environmental information held by public authorities.<\/p>\n<p align=\"left\">The Regulations do this in two ways:<\/p>\n<p>public authorities must make environmental information available proactively;<\/p>\n<p>members of the public are entitled to request environmental information from public authorities.<\/p>\n<p align=\"left\">The Regulations cover any recorded information held by public authorities in England, Wales and Northern Ireland. Environmental information held by Scottish public authorities is covered by the Environmental Information (Scotland) Regulations 2004.<\/p>\n<p>Some sensitive information might not be available to members of the public. If this is the case, the organisation must tell you why they have withheld some or all of the information you requested.<\/p>\n<p>An organisation can turn down your request if they think it will cost them more than \u00a3450 (\u00a3600 for a central government organisation) to deal with your request.<\/p>\n<p>We\u00a0 made an FOI\u00a0\u00a0request to Sandwell Council \u00a0using the WhatDoTheyKnow? Website at <a href=\"http:\/\/www.whatdotheyknow.com\/\" target=\"_blank\">whatdotheyknow.com<\/a>. This site is operated by a UK charity, and provides the mechanism for submitting FOI requests and storing the responses from the public authorities. The replies are stored and made publicly available on the WhatDoTheyKnow website.<\/p>\n<p>The request that we made to the public site can be read <a title=\"&quot;relocation&quot; of geese\" href=\"https:\/\/www.whatdotheyknow.com\/request\/relocation_of_canada_geese#incoming-542442\" target=\"_blank\">HERE. <\/a><\/p>\n<p>Instead of replying directly to this public site, so that everyone could read what information they held, Sandwell council decided as another act of cowardice to send it to my home address, rather than publicly post it on the WDTK website where everyone could read it. Below we outline their response to the request and what it all means.<\/p>\n<p>&nbsp;<\/p>\n<div id=\"attachment_70\" style=\"width: 610px\" class=\"wp-caption alignnone\"><a href=\"http:\/\/saveoursandwellcanadageese.org.uk\/wp-content\/uploads\/2014\/08\/IMGA0707.jpg\"><img aria-describedby=\"caption-attachment-70\" decoding=\"async\" loading=\"lazy\" class=\"wp-image-70\" src=\"http:\/\/saveoursandwellcanadageese.org.uk\/wp-content\/uploads\/2014\/08\/IMGA0707.jpg\" alt=\"IMGA0707\" width=\"600\" height=\"338\" srcset=\"https:\/\/saveoursandwellcanadageese.org.uk\/wp-content\/uploads\/2014\/08\/IMGA0707.jpg 640w, https:\/\/saveoursandwellcanadageese.org.uk\/wp-content\/uploads\/2014\/08\/IMGA0707-300x168.jpg 300w\" sizes=\"(max-width: 600px) 100vw, 600px\" \/><\/a><p id=\"caption-attachment-70\" class=\"wp-caption-text\">Quite a lot to hide in there.<\/p><\/div>\n<p>&nbsp;<\/p>\n<p><strong>WHAT DID WE ASK AND <\/strong><strong>WHAT DID THEY KNOW?<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>1.Could you supply me with the following information.<\/p>\n<p>The cabinet report concerning the \u201crelocation\u201d of Canada geese from Victoria park Tipton and Dartmouth park undertaken by PESTEX last year in July. I cannot find any such document on your website, does it indeed exist?<\/p>\n<p>A1<\/p>\n<p><strong><em><span style=\"color: #ff0000;\">\u201cThere was no cabinet report regards approval to relocate the geese. A cabinet briefing was presented to the cabinet member \u2013 this is not a public document. We do not hold any information regarding the approval of the process; as such approval was given verbally for 2013\/14.\u201d<\/span><\/em><\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>2. On 16th July PESTEX again removed around 70 geese from this park. What approval has been given for this operation? I am requesting relevant emails or correspondence which give approval for this task, as well as for that last year. I am also requesting the cost of this operation and which budget it came from.<\/p>\n<p><strong><em><span style=\"color: #ff0000;\">\u201cA2 The briefing was approved to remove the geese from both Victoria Park and Dartmouth Park in 2013 and to repeat the action in 2014.<\/span><\/em><\/strong><\/p>\n<p><strong><em><span style=\"color: #ff0000;\">Section 21 of The Freedom of Information Act 2000 allows public authorities not to disclose information reasonably available to the requestor by other means, in this case, the information you have requested is already publicly available on:<\/span><\/em><\/strong><\/p>\n<p><strong><em><span style=\"color: #ff0000;\">http:\/\/www.sandwell.gov.uk\/downloads\/download\/736\/transparency-creditor_payments_over_500<\/span><\/em><\/strong><\/p>\n<p><strong><em><span style=\"color: #ff0000;\">The budget for this work was funded from the Parks and Countryside revenue budget.\u201d<\/span><\/em><\/strong><\/p>\n<p>3 Can I ask for confirmation that these birds were killed by this pest control company and this task was therefore authorized by a Sandwell council officer or cabinet member.<br \/>\nI am certain that these birds were not \u201crelocated\u201d to the stated area that they were going to, and this would require authorization from Natural England in order to do this. Could you therefore supply me with the licence that you obtained from them to relocate<br \/>\nthese birds which were transported by the pest control company unrestrained in the back of a horse trailer for approximately 3 miles if the claim of \u201crelocation\u201d is to be believed.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><em><span style=\"color: #ff0000;\">\u201cA3 The council can confirm the geese were culled under licence following strict guidelines as advised by Natural England.<\/span><\/em><\/strong><\/p>\n<p><strong><em><span style=\"color: #ff0000;\">As for the licence you requested a copy of, the council does not hold this information for the purposes of The Freedom of Information Act 2000. Indeed, Section 3(2) of the Freedom of Information Act 2000 only subjects information held by the council to disclosure. In this case, the council has outsourced the culling of the geese and the licence you wish to obtain a copy of has been awarded to our contractor for them to carry out their business; it does not fall within the scope of application of the Act. As a result, the council is satisfied it is entitled not to provide you with a copy of it. <\/span><\/em><\/strong><\/p>\n<p><strong><em><span style=\"color: #ff0000;\">The work was undertaken by the company PESTEX whom are licensed to undertake such work and who informed Natural England of the action taken. The geese were transported by the company in an appropriate trailer and were dispatched to a discreet location\u201d<\/span><\/em><\/strong><\/p>\n<p>The letter is printed below<\/p>\n<p><a href=\"http:\/\/www.whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2014\/08\/scan0014.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone wp-image-5947\" src=\"http:\/\/www.whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2014\/08\/scan0014.jpg\" alt=\"scan0014\" width=\"626\" height=\"841\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"http:\/\/www.whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2014\/08\/scan0015.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"wp-image-5948 aligncenter\" src=\"http:\/\/www.whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2014\/08\/scan0015.jpg\" alt=\"scan0015\" width=\"625\" height=\"969\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"http:\/\/www.whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2014\/08\/scan0021.jpg\"><img decoding=\"async\" loading=\"lazy\" class=\"alignnone wp-image-5952\" src=\"http:\/\/www.whatliesbeneathrattlechainlagoon.org.uk\/wp-content\/uploads\/2014\/08\/scan0021.jpg\" alt=\"scan0021\" width=\"625\" height=\"882\" \/><\/a><\/p>\n<p>&nbsp;<\/p>\n<p><strong>WHAT DOES THIS MEAN?<\/strong><\/p>\n<p>Why is the cabinet briefing not a public document if it was a written document? We have now obtained <a title=\"Satchwell's biased report\" href=\"http:\/\/saveoursandwellcanadageese.org.uk\/?p=190\" target=\"_blank\">this briefing<\/a>, following another FOI request, which confirms how it\u00a0 is devoid of any scientific evidence and\u00a0 reveals who was behind the cull- namely John Satchwell. According to this, Councillor Maria Crompton authorised this cull verbally, and again there is no public record of this it seems according to the response to question 1. The response is vaguely worded and does not answer the question. We had already obtained information from Natural England that they would not have authorised any relocation of geese. We just wanted Sandwell council to admit the lies that they and their contractor had initially tried to tell.<\/p>\n<p>The pest control contractor that Sandwell Council used, PESTEX are liars. They tell people untruthful information about their clandestine murderous activities. That it is \u201clawful\u201d\u00a0 or they have a general licence does not make it morally right when those making the laws do so for their own personal financial gain, which they then try to justify with unproven scientific facts about their discrimination and scapegoating of \u201cnon-native species.\u201d<\/p>\n<p>That a Senior\u00a0officer of\u00a0Sandwell\u00a0council with a vested personal interest in Victoria Park Tipton also lied to me both directly to my face and several times when questioned on the phone to which he ended by putting the phone down on me, reveals both his cowardice and the fact that he is also a liar.<\/p>\n<p>Any cabinet briefing would have been carried out by this same biased officer whom it seems has both a personal phobia and hatred towards this species that have lived happily there longer than he has.<\/p>\n<p>The response in question 2 unhelpfully does not refer to a public document which can be viewed but a series of payments with redacted information. We can find no payment or mention of\u00a0PESTEX at the link given, nor the budget for parks and countryside revenue. There is no breakdown of any payments made under the \u201cstreet scene\u201d spend either \u2013 Steve Handley being the director of this department. Indeed this link is just another wild goose chase. They again refer to the briefing but I do not believe that they are disclosing the truth when they claim that no communication other than this exists. What about the tendering process of choosing this company, or are there some relationships or connections to Sandwell council here?<\/p>\n<p><span style=\"text-decoration: underline;\"><strong><span style=\"color: #ff0000; text-decoration: underline;\">WE HAVE REQUESTED AN INDEPENDENT REVIEW ASKING FOR CLARIFICATION ON THIS MATTER.<\/span><\/strong><\/span><\/p>\n<p>In question 3 we get the blunt truth, and the end to the lies of \u201crelocation\u201d. Why are guidelines always \u201cstrict\u201d when it comes to defending murder of wildllife?\u00a0 What evidence do the council possess that it was strictly carried out, and by what method was it carried out? Were they shot one by one out of sight of the flock, gassed, did they have their necks broken by a group of thugs who rounded them up? This is detail that Sandwell councillors like Crompton wash their delicate little hands of. No doubt they also feed their own animals \u00a0without the thought weighing on their minds, then read bedtime stories to their children or grandchildren with pretty pictures of birds and animals \u2013 but not the cold reality in these stories of how verbally they gave approval to murder defenceless birds in the real world that could not escape.<\/p>\n<p>Natural England require the applicant for a general licence to explain what type of licence they need to apply for when scrutinised. We doubt if this briefing ever got this far, indeed when questioning Satchwell last year he stated \u201cwe don\u2019t need a licence\u201d- this was to relocate them, which proves just how little he knows about the entire process.<\/p>\n<p><em><span style=\"color: #ff0000;\">\u201cThe work was undertaken by the company PESTEX whom are licensed to undertake such work and who informed Natural England of the action taken. The geese were transported by the company in an appropriate trailer and were dispatched to a discreet location\u201d<\/span><\/em><\/p>\n<p>email received by Natural England<\/p>\n<h3 id=\"yui_3_16_0_1_1408218482381_5082\" class=\"yiv9795773254MsoNormal\"><span id=\"yui_3_16_0_1_1408218482381_5081\" style=\"color: black;\">\u201cThank you for your email, which has been passed to me to respond<\/span><\/h3>\n<h3 id=\"yui_3_16_0_1_1408218482381_5089\" class=\"yiv9795773254MsoNormal\"><span id=\"yui_3_16_0_1_1408218482381_5091\" style=\"color: black;\">We do not grant licences for the relocation of Canada geese and <\/span><span id=\"yui_3_16_0_1_1408218482381_5088\"><span style=\"color: #000000;\">there is a presumption against issuing licences to relocate Canada geese in the foreseeable future. <\/span><span style=\"color: black;\">We have not issued a licence in relation to the details you have given.<\/span><\/span><\/h3>\n<h3 class=\"yiv9795773254MsoNormal\"><span style=\"color: black;\">\u00a0<\/span><span id=\"yui_3_16_0_1_1408218482381_5092\" style=\"color: black;\">Under the Wildlife &amp; Countryside act it would be considered an offence to release Canada geese into the wild, as they are a Schedule 9 species. We would urge anyone who encounters them to ask questions, do not co-operate with them if they try to get you to feed the birds towards them, disrupt their activities and chase any birds they are after into the water and away from their death traps.<\/p>\n<p>This council, Sandwell,\u00a0are a Labour council in power, which reveals what they would do in power nationally. They are hypocrites, liars and have a perversion for keeping things in the family and looking after their own cronies, as they themselves grow ever fatter in stature. They also don\u2019t like being caught out, and on this point they have seriously underestimated a master at work. I\u00a0have referred a complaint to Natural England as to how Sandwell council broke the law in an attempt to deceive a member of the public who questioned their activities that were never briefed professionally on in the first place.<\/p>\n<p>We regret, and I regret that I was not able to stop PESTEX and Sandwell council this year.<\/p>\n<p id=\"yui_3_16_0_1_1408218482381_5082\" class=\"yiv9795773254MsoNormal\">They will not get away with this murder, and it will be made public knowledge about what they have done, with all the personal criticism and scrutiny that they would not want when they tried to hide their actions from public knowledge.<\/p>\n<p>On every count regarding their allegations of Canada geese, we can refute and will refute their bigoted, misinformed and misguided views which are not facts substantiated with any personal experience or scientific evidence.
